  Introduction
1.1 These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and Mediqconnect Healthcare Pvt. Ltd., operating under the brand name “MediQ” (“MediQ”, “we”, “our”, “us”).
1.2 These Terms govern your use of the MediQ website, mobile application and all features, tools, products, and services offered through MediQ (“Services”).
1.3 By accessing or using MediQ, you acknowledge that you have read, understood, and agreed to these Terms and the MediQ Privacy Policy. If you do not agree, you must discontinue use of the Services immediately.

  Nature of Services – MediQ as an Intermediary
2.1 MediQ is a digital healthcare facilitation platform that enables users to:
a. search and book appointments with doctors and clinics,
b. access Quick Video Consultation (QVC) with licensed doctors,
c. receive electronic prescriptions,
d. store electronic health records,
e. request home healthcare services,
f. receive home delivery of medicines from partner pharmacies,
g. access the MediQ Mediclaim Helpline,
h. use MediQ Wallet and MediQ Points.
2.2 MediQ is an intermediary under applicable Indian law. MediQ does not provide medical advice, diagnosis, treatment, pharmacy services, or emergency care. All medical services are delivered solely by independent licensed practitioners or partner service providers.
2.3 MediQ does not recommend, endorse, or guarantee any specific practitioner, clinic, pharmacy, service provider, medication, treatment plan, or outcome. The user is solely responsible for selecting and engaging with healthcare providers.

  Eligibility & Registration
3.1 You must be at least 18 years old to register and use MediQ.
3.2 You agree to provide accurate, complete, and updated information while creating your account. MediQ may suspend or terminate accounts containing false, misleading, or incomplete information.
3.3 Parents or legal guardians may use MediQ to seek services on behalf of a minor child, and assume full responsibility for all actions taken.

  User Responsibilities
4.1 You agree not to misuse MediQ, impersonate others, engage in illegal activities, or upload harmful or unlawful content.
4.2 You are responsible for safeguarding your login credentials, device security, and all activities conducted under your account.
4.3 You agree not to resell, modify, duplicate, or misuse prescriptions or app-generated documents.

  Telemedicine & Quick Video Consultation (QVC)
5.1 QVC connects users with licensed MBBS doctors practicing under the Telemedicine Practice Guidelines, 2020.
5.2 By starting a video consultation, you provide explicit informed consent for telemedicine.
5.3 Doctors may issue an electronic prescription based solely on their clinical judgment. MediQ does not influence medical decisions.
5.4 Doctors may refuse prescriptions if the case is unsuitable for telemedicine.
5.5 If you consent, MediQ may share your prescription with a partner pharmacy.

  Pharmacy Fulfilment (Medicine Delivery)
6.1 MediQ is not a pharmacy and does not stock, store, sell, or deliver medicines.
6.2 When you request medicine delivery:
a. MediQ only transmits your prescription to a partner pharmacy,
b. the pharmacy contacts you directly,
c. payment is collected by the pharmacy, not MediQ,
d. delivery, pricing, timelines, stock availability, and quality are the responsibility of the pharmacy.
6.3 MediQ is not liable for medicine delivery issues, wrong medicines, delays, side effects, reactions, pricing disputes, or pharmacy errors.

  Home Healthcare Services
7.1 When you request a home visit, MediQ forwards your request to a partnered provider (currently Sahaj Home Healthcare).
7.2 All services, treatment, charges, staff conduct, and payments are directly between you and the provider.
7.3 MediQ is not responsible for quality, outcomes, or disputes related to home healthcare.

  Practitioner Relationship
8.1 Practitioners on MediQ are independent professionals and are not employees or agents of MediQ.
8.2 Practitioners must maintain valid medical registrations and comply with applicable laws.
8.3 MediQ may delist or suspend practitioners for misconduct, non-compliance, or user safety concerns.
8.4 MediQ is not liable for doctor behavior, accuracy of advice, delays, cancellation, negligence, misdiagnosis, treatment failure, or adverse reactions.

  Health Records (EHR)
9.1 MediQ stores your health records on secure, encrypted servers. Server locations may include India or other countries depending on technology infrastructure.
9.2 Practitioners are responsible for the accuracy of records they upload.
9.3 You may request deletion of your MediQ account. Practitioner-held records remain as required by law.
9.4 MediQ is not liable for data loss due to third-party issues, device faults, or network failures.

  Emergency Disclaimer
10.1 MediQ is not intended for emergencies or life-threatening situations.
10.2 In case of emergency, call local emergency services or visit the nearest hospital immediately.

  Appointments, Cancellations & Refunds
11.1 Appointment fees are collected based on practitioner or clinic policy.
11.2 If a paid appointment is cancelled by the practitioner or clinic, refunds may be issued to your MediQ Wallet within 5–6 working days.
11.3 If you miss an appointment without cancellation, MediQ may restrict your booking privileges.
11.4 Refunds for user-initiated cancellations depend on the practitioner’s refund policy.
11.5 QVC sessions partially completed or disconnected due to user network issues may not be eligible for refund.

  MediQ Wallet & MediQ Points
12.1 New users receive 100 MediQ Points.
12.2 Points may be used to get up to 10% discount per doctor consultation.
12.3 Points and Wallet balance have no cash value and cannot be transferred or withdrawn.
12.4 Points may expire after 12 months or as updated on the platform.
12.5 MediQ may modify or discontinue the wallet or points system at any time.

  User Content & Feedback
13.1 Users may post feedback or reviews about practitioners and services.
13.2 Content must be truthful, lawful, and non-defamatory.
13.3 MediQ may remove or moderate content violating these Terms.
13.4 By submitting content, you grant MediQ a worldwide, royalty-free license to use it for platform improvement, marketing, and operations.

  Restricted Activities
You agree not to:
a. upload illegal, harmful, abusive, or infringing content,
b. attempt unauthorized access to MediQ systems,
c. scrape, duplicate, reverse-engineer, or copy platform content,
d. disrupt or bypass security features,
e. misrepresent your identity or credentials,
f. misuse prescriptions or medical documents.

  Payments
15.1 Payments for appointments and QVC are processed through third-party payment gateways. MediQ does not store card or banking details.
15.2 Payments for medicines and home healthcare are handled directly by the provider and not by MediQ.
15.3 MediQ is not liable for payment failures or gateway errors.

  Data Usage, Sharing & Compliance
16.1 MediQ may share your information with practitioners, diagnostic centers, pharmacies, insurers, or healthcare partners solely for delivering services.
16.2 Data may be stored in India or other countries depending on hosting infrastructure.
16.3 MediQ may disclose information to authorities where required by law.
16.4 Users consent to receiving SMS, WhatsApp, email, app notifications, and promotional messages from MediQ.

  Suspension & Termination
17.1 MediQ may suspend or terminate accounts for:
a. violation of Terms,
b. fraudulent activity,
c. fake bookings,
d. misuse of prescriptions,
e. illegal or harmful conduct,
f. abuse of MediQ Points.
17.2 Termination may lead to loss of wallet balance or points. No compensation is provided.
17.3 Certain data may be retained for compliance purposes even after account deletion.

  Limitation of Liability
18.1 MediQ provides services on an “as is” and “as available” basis.
18.2 MediQ is not responsible for indirect, incidental, punitive, or consequential damages.
18.3 Maximum liability of MediQ, for any claim, shall not exceed INR 1,000 or the amount paid by you to MediQ in the preceding 12 months, whichever is higher.

  Indemnity
You agree to indemnify and hold harmless MediQ, its directors, employees, partners, and agents from any claims, damages, or losses arising from your use of the Services or violation of these Terms.

  Governing Law & Dispute Resolution
20.1 These Terms are governed by the laws of India.
20.2 All disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996.
20.3 The seat and venue of arbitration shall be Rajkot, Gujarat.
20.4 Subject to arbitration, courts in Rajkot shall have exclusive jurisdiction.

  Modifications to Terms
MediQ may update these Terms at any time. Users will be notified of major changes. Continued use of the Services signifies acceptance of the revised Terms.
